Make a legal will in Quebec
A Quebec will made before witnesses under the Civil Code of Québec — drafted online in about 20 minutes, with a step-by-step signing guide.
What makes a will valid in Québec.
Grounded in the Civil Code of Québec (CCQ). The wizard surfaces these rules in plain language as you go — no need to memorise them up front.
- Forms recognized
- Three: notarial (made by a notary), holograph (entirely handwritten), and made before two witnesses. Legalify produces the before-witnesses form.
- CCQ, arts. 712–730
- Who can make a will
- Anyone of full age (18) with capacity. A minor may will only property of little value.
- CCQ, arts. 708, 711
- Will before witnesses
- You declare, before two witnesses of full age, that the document is your will, then you and both witnesses sign.
- CCQ, art. 727
- Holograph wills
- Valid if written entirely by your own hand and signed, with no other formality and no witnesses.
- CCQ, art. 726
- Probate (verification)
- Holograph and before-witnesses wills must be verified by a court or notary after death. Notarial wills do not require verification.
- CCQ, arts. 772–775
- Civil-law framework
- Quebec's rules differ from the common-law provinces, including protections for the family patrimony and the surviving spouse.
- Civil Code of Québec
Quebec is governed by the Civil Code, not the common law — so the forms and the after-death verification step differ from the rest of Canada. For maximum security, a notarial will (prepared by a notary) avoids the verification step entirely.

Do I need a notary to make a will in Quebec?
Only if you want a notarial will — the most secure form, kept in the notary's records and needing no court verification after death. Holograph wills and wills made before two witnesses are also valid without a notary, but they must be verified by a court or notary after death before they can be acted upon. Legalify produces a will made before witnesses; for complex estates or maximum security, we recommend seeing a notary.
What forms of will are valid in Quebec?
Three under the Civil Code of Québec: notarial (art. 716), holograph (art. 726 — entirely handwritten and signed by you), and made before witnesses (art. 727 — you declare before two adult witnesses that it's your will, then everyone signs). Each has its own requirements.
Does a Quebec will made online need to be probated?
A holograph will or a will made before witnesses must be verified ('probated') by a court or a notary after death before it can be acted upon (CCQ arts. 772–775). Only a notarial will skips this step. The included instructions explain what your liquidator will need to do.
Who can witness my will in Quebec?
For a will made before witnesses, two witnesses of full age. You declare to them that the document is your will (they don't need to read it), then you sign in their presence and they sign. Choose disinterested witnesses, and we'll walk you through the exact wording and steps.

Please note
Legalify provides self-help document software, not legal advice, and is not a law firm or a substitute for a lawyer or notary. The information on this page is general and factual — it is not advice about your situation. For complex estates — blended families, dependants who need support, business interests, trusts, or assets outside Canada — we recommend advice from a licensed notary or lawyer in Québec. The wizard will also flag, mid-flow, when professional advice is the right call.
